1. Company Information

In compliance with Article 10 of Spanish Law 34/2002 of 11 July, on information society services and electronic commerce (LSSI-CE), the following information is provided regarding the operator of this website:

StayInFuerte operates an online vacation rental marketplace for Fuerteventura (Canary Islands, Spain) and provides information society services to users within the European Union. As the service is directed at the Spanish market, it operates in accordance with Spanish internet law (LSSI-CE).

2. Domain and Service

This Legal Notice governs the use of the website operating under the domain stayinfuerte.com (the "Platform").

The Platform is an online marketplace that connects independent property hosts offering vacation rentals in Fuerteventura with tourists seeking accommodation. StayInFuerte facilitates the publication of listings and the exchange of inquiries between hosts and guests, but is not a party to any rental contract entered into between users.

3. Intellectual Property

All elements of the Platform — including but not limited to the source code, design, layout, graphics, logos, trademarks, texts, databases and software — are the property of AGERE - Krzysztof Blask or its licensors and are protected by Spanish, European and international intellectual property law.

Reproduction, distribution, public communication, transformation or any other use of all or part of the Platform's contents without the prior written authorisation of the owner is prohibited.

Content submitted by users (property listings, photographs, descriptions, messages) remains the intellectual property of the user who submitted it. By publishing such content on the Platform, the user grants StayInFuerte a non-exclusive, royalty-free, worldwide licence to display, reproduce and distribute that content for the purpose of operating and promoting the Platform.

4. Liability Limitation

StayInFuerte acts solely as an intermediary marketplace. We are not a party to the rental contracts that users (hosts and guests) may enter into through the Platform and we assume no responsibility for the performance of those contracts.

Listings, prices, availability, descriptions, photographs and any other information published on the Platform are provided by the hosts. While we apply reasonable measures to review submissions, we do not guarantee the accuracy, completeness or up-to-date status of host-submitted content. Users are responsible for verifying the information before booking.

The Platform may contain links to third-party websites for the convenience of users. StayInFuerte does not control these sites and is not responsible for their content, privacy practices or availability.

To the maximum extent permitted by law, StayInFuerte shall not be liable for any direct, indirect, incidental or consequential damages arising from the use of, or inability to use, the Platform, including damages resulting from interruptions, technical errors or actions of third parties.

5. Applicable Law and Jurisdiction

This Platform and the legal relationship between StayInFuerte and its users are governed by Spanish law.

Any dispute arising from the use of the Platform shall be submitted to the courts of Spain, without prejudice to the mandatory consumer protection rules applicable to the user's country of residence within the European Union. Consumers may also use the European Commission's online dispute resolution platform, available at ec.europa.eu/consumers/odr.

6. Regulatory Information

StayInFuerte operates as an information society service within the meaning of Spanish Law 34/2002 (LSSI-CE) and Directive 2000/31/EC on electronic commerce. No specific professional licence is required to operate as an intermediary marketplace.

Vacation rental activities themselves are subject to the regional regulations of the Canary Islands (Decreto 113/2015 and subsequent amendments). Each host is responsible for ensuring that their property complies with local registration, licensing and tax obligations.
