Terms of Service

By accessing or using StayInFuerte (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. We reserve the right to modify these terms at any time; continued use after changes constitutes acceptance.

StayInFuerte is an online marketplace that allows property hosts to list vacation rental properties and enables tourists to discover and contact property hosts. The Platform is not a party to any rental agreements between guests and hosts. We do not book properties, collect payments, or take responsibility for rental contract terms.

To use most Platform features, you must register with a valid email address, a secure password, your full name, and your intended role (guest or host). You are responsible for keeping your password confidential and for all activity under your account. You must be at least 18 years old.

If you list a property, you agree to:

• Provide truthful and accurate descriptions
• Comply with Spanish law and Canary Islands tourism regulations
• Display any required local licenses
• Declare applicable taxes (IGIC, tourist tax)
• Maintain your property in safe condition
• Treat all guests without discrimination

You are solely responsible for obtaining rental permits, paying applicable taxes, following local rental restrictions, and complying with building codes and safety standards.

If you use the Platform to contact property hosts, you agree to:

• Provide accurate personal information
• Communicate honestly
• Treat hosts with respect
• Follow house rules
• Not use the Platform to spam or solicit unrelated services

All users agree not to:

• Send unsolicited messages or spam
• Post false or misleading listings
• Misrepresent themselves
• Attempt unauthorized access
• Post illegal content
• Violate intellectual property rights
• Harass other users

Violations may result in immediate suspension or permanent account termination.

By uploading content to the Platform, you grant StayInFuerte a non-exclusive, royalty-free, worldwide licence to display, store, and process your content for Platform functionality. You retain ownership of your content.

All Platform code, design, logos, and materials are owned by StayInFuerte or our licensors. Unauthorized use is prohibited.

The Platform is an intermediary service only and is provided "as-is" without warranties. We make no representations regarding the accuracy or safety of property listings or the conduct of other users.

To the fullest extent permitted by law, StayInFuerte is not liable for: disputes between guests and hosts; guest injuries or property damage; loss of data; or indirect or consequential damages. Our maximum liability is limited to fees you have paid to the Platform in the preceding 12 months, or EUR 100, whichever is greater.

These limitations do not apply to death or personal injury caused by our negligence, fraud, or liability that cannot be excluded under Spanish law.

When you search for properties, listings are ordered based on a combination of factors. This section explains the main parameters, in order of importance.

1. Featured status. Properties we mark as featured — either through a promotional placement we control, or a time-limited (30-day) boost earned by a host who claims their imported listing promptly — appear first, and are marked with a "Featured" badge.
2. Claimed vs. unclaimed. Within each group, properties actively managed by a verified host rank above properties that have been imported but not yet claimed by their owner, since unclaimed listings cannot receive direct inquiries.
3. Rotation. Among featured listings, the order is reshuffled every six hours using a randomised rule, so that no single featured property permanently occupies the top position.
4. Newest first. As a final tiebreaker, more recently added listings appear before older ones.

You can additionally sort results by price using the sort control on the search page. Filters (location, guest count, bedrooms, amenities, etc.) narrow which properties appear in your results but do not affect their order. Ranking is the same for every user of the same search query, aside from the six-hour rotation above.

Featured placement is not for sale — hosts cannot pay to appear higher in search results.

Under the EU Consumer Rights Directive (2011/83/EU), consumers normally have the right to withdraw from a distance contract within 14 days without giving any reason.

However, Article 16(l) of the Directive provides an exception for accommodation services where a specific date or period of performance is agreed. Since all property rentals listed on this Platform are booked for specific dates, the 14-day right of withdrawal does not apply once the booking has been confirmed by the property host.

By submitting an inquiry or confirming a booking, you expressly acknowledge that:

• The rental service is for a specific date or period of performance;
• The right of withdrawal is therefore excluded under Article 16(l) of Directive 2011/83/EU;
• Cancellation terms, refund policies, and any applicable fees are agreed directly between you and the property host and should be confirmed in writing before committing to a rental.

This exclusion does not affect any other statutory rights you may have under applicable national consumer protection law.

Disputes between guests and hosts are the responsibility of the parties involved. We encourage users to agree on cancellation and booking policies in writing before committing to a rental.

EU consumers may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. All legal disputes are subject to Spanish law and the jurisdiction of Spanish courts.

We may suspend or terminate accounts that violate these Terms, engage in illegal activity, or harm other users. You may delete your account at any time from your Profile settings.

These Terms are governed by Spanish law. You consent to the exclusive jurisdiction of Spanish courts, subject to EU consumer rights where applicable.
